Any purchase of products from this site will be governed by these terms and conditions to the exclusion of any other terms and conditions.
Use of this site and purchase of goods from it implies your acceptance of these terms and conditions.
All products are subject to availability.
All orders are subject to acceptance by us.
Any advice or recommendation given by us is followed or acted upon entirely at your own risk.
The quantity, quality, description, and any specification of products featured on this site are considered to be accurate to the best of our knowledge and belief.
You should be aware that the images appearing in this site are not always accurate.
We reserve the right to correct errors and/or omissions in any price or other information without any liability or obligation to supply to you at the incorrect or previous price.
It is your responsibility to ensure that you are proficient and qualified in the safe use of any product purchased from us.
We shall have no liability to you for injuries related to any products that you purchase from this site and which you then subsequently use without the requisite training and/or experience.
The prices shown on the Mash Ways site are for online sales only. We are happy to accept orders by telephone or in person, but please be aware that different prices may apply to those shown on this website.
All prices on this site are subject to change without prior notice in the event of any increase in cost to us.
WE DO NOT SEND ANY GOODS OUTSIDE OF THE UK. ALL GOODS MUST BE DELIVERED TO A VALID UK ADDRESS or BFPO ADDRESS
Payment is due at the time you place your order.
Payment will normally be debited from your card when the goods are ready for dispatch to you.
We undertake full credit and debit card verification checks to help prevent mail-order card fraud.
We will report to the necessary authorities any person attempting to use a card that they are not authorized to use or which appears to us to be fraudulent.
Despatch and Delivery
It is our aim to dispatch in-stock items to you within 24 hours of receipt of your order.
Due to the limited availability of some of the products we sell, a particular item may be out of stock. If this occurs we will contact you and request your preferences regarding order dispatch.
If you have asked that goods be sent to you in more than one shipment, please be aware that by doing so, you agree to pay for the shipping charges on each separate consignment.
If you elect for your order to be sent in more than one shipment we will debit a second carriage charge at the time the goods are dispatched.
If items continue to be unavailable, we will contact you to ask for an alternative or to see if you would rather cancel your order.
We will keep you informed about expected delivery times (you can check the progress of your order by viewing your account and order status), but please allow up to 28 days for delivery. Any delivery date for goods that are out of stock will be an estimate only as we are in the hands of our suppliers and therefore do not have full control over expected delivery times.
We will not be liable for delays or other consequential losses caused by matters which are outside our control.
If your order is required by a specific date, please make us aware of this at the time you place your order.
Any claim based on any defect in quality or condition of the products at the time you receive them must be notified to us within 3 days of delivery.
If you fail to notify us about any defects or damage within the 3 days specified above, you will be deemed to have accepted the goods.
Risk of damage to or loss of the product shall pass to you at the point at which they are satisfactorily delivered.
Title of goods remains with Mash Ways and shall pass to you only upon receipt of cleared funds by us. Risk of damage or loss of the product shall pass to you at the point at which they are satisfactorily delivered.
Mash Ways asserts all of its intellectual property rights in all of its promotional material both written and pictorial and trademarks.
Warranties and Liability
Where possible all products supplied conform to all relevant British and European standards.
If there is a defect in any product(s) sold by us to you, then we will replace the defective product(s) free of charge or if you choose not to have a replacement you are entitled to a full refund of the price paid for the product (or a proportionate part of the price).
Returning a wrong size or faulty goods
At Mash Ways, we want you to be confident that you have our full support when making a purchase and that should any product prove to be faulty we will ensure it is repaired or replaced and returned to you with the least disruption.
If any product that is purchased from Mash Ways is the incorrect size for you, we will exchange it for the correct size providing that the product has not been used in any way and is returned to us in its original packing “as new” and able to be immediately resold by us.
Any product that is returned for an exchange must first be notified to us by requesting a returns authorization; you can do this either by telephoning us or by email. Give us as much detail as you can. We will then contact you to establish the best course of action to get the problem resolved to your satisfaction. If the item needs to be returned to us you can be assured either we or the manufacturer will remedy the problem as quickly as possible.
For goods that are the wrong size, you will be responsible for the cost of carriage for returning the goods to us.
We reserve the right to charge an additional carriage charge to you for supplying replacement items where the original item was correctly supplied but is the wrong size.
If any product that is purchased is faulty we will exchange it for an identical replacement free of charge provided that the product is returned to us in its original packaging and the fault is notified to us as above. Before dispatch of a replacement item, we reserve the right to have any fault verified, either by us or by the manufacturers.
Your statutory rights are unaffected.
Your Right to Cancel
You may cancel your order and return the products to us and receive a refund at any time up to seven days after you have received the product(s).
We must be notified within seven days of the dispatch of goods by email or letter if you intend to return the goods and you then have twenty-eight days from the date of dispatch to have the goods returned to us.
The product(s) must not have been used in any way and must be returned to us in original packing “as new” and able to be immediately resold by us.
To cancel or return all or part of an order you must seek authorization from us, by email requesting that the order be canceled.
You are liable for the return carriage charge.
A refund will only be given when the goods have been returned to us in their original condition and are suitable to be re-sold as new without us incurring any extra costs.
Your custom is important to us and we want you to shop with us again; If you are not happy with the service you have received please contact us either by telephone, e-mail or by writing to us setting out the nature of your complaint. We will do all we can to resolve your complaint or concern.
You are not entitled to assign or transfer any of your rights or obligations under this contract.
This contract shall be governed by the laws of England and Wales and you agree to submit to the non-exclusive jurisdiction of the English courts.
